Schedule 4: Terms and Conditions for Users to Access, Download and Use Records.

When you USE British Library RECORDS from DIMDI you agree to the terms and conditions detailed below.

1.  INTERPRETATION

1.1 For the purpose of interpreting this document, the following definitions shall apply:

"DATABASE" means the collection of RECORDS in machine readable format created, modified enhanced or edited by the British Library and to which you have access under these Terms and Conditions of Use.

"DOWNLOAD" means the production, or the production and storage, of a  paper or electronic copy of a RECORD by you and 'DOWNLOADING' and ‘DOWNLOADED’ shall be construed accordingly.

"METADATA HARVESTING" means the unrestricted gathering of data from the internet whereby access to such data is gained without requirement of prior licence, payment or password and includes (but is not limited to) access to any server which supports the Open Archives Initiative Protocol for Metadata Harvesting.

"NON-COMMERCIAL USE" means use solely for the purposes of resource discovery, learning, teaching, academic research or private study and specifically excludes transmission, selling on, redistribution or circulation of the whole DATABASE or substantial parts thereof  outside your organisation.
 
"RECORD" means, as appropriate a complete machine-readable bibliographic description from the DATABASE.

"USE" means to access, download, produce, or produce and store, a  paper or electronic copy of a RECORD by you solely for NON-COMMERCIAL USE and 'USING' and 'USED' shall be construed accordingly.

2.  GRANT OF LICENCE AND USE OF THE RECORDS

2.1 The British Library grants you a non-transferable, non-exclusive licence to access the DATABASE and DOWNLOAD and USE RECORDS in accordance with these Terms and Conditions.  The licence is personal to you and the grant does not include the right to grant sub-licences.

2.2 You shall use the RECORDS and the information available or obtained from the RECORDS solely for resource discovery, personal use for the purposes of learning and teaching, academic or scientific research or private study.

2.3 You may print out and save the RECORDS, but your attention is drawn specifically to Clause 8 of these Terms and Conditions.

2.4 You acknowledge that the use of the RECORDS requires you to use your own skill and judgement and you accept that the British Library shall not have any liability in respect of any third party claims against you.

2.5 You accept that any RECORD is for use by yourself or by you within your organisation solely for NON-COMMERCIAL USE.

2.6 You shall use your best endeavours to ensure that your equipment and/or software used to access the DATABASE shall not corrupt the DATABASE or the RECORDS.

3.  PROHIBITED USES

3.1 Your use of the RECORDS and the DATABASE is restricted solely to the purposes set out in Clause 2 of these Terms and Conditions.  You shall not:

3.1.1 make any additions, deletions, modifications, adjustments or alterations to the RECORDS or the DATABASE;
3.1.2 attempt to rectify or permit any persons other than the British Library or their agents to rectify any fault or inaccuracy in the RECORDS or the DATABASE;
3.1.3 infringe or permit the infringement or otherwise prejudice the proprietary rights of the British Library or individual publishers contributing to the DATABASE;
3.1.4 use any equipment and/or software in a manner that is inconsistent with these Terms and Conditions;
3.1.5 transmit, sell on, redistribute or circulate the RECORDS or the DATABASE outside your organisation,
3.1.5 link your own database or any equipment, software or service to the DATABASE so that the RECORDS can be accessed, used, stored or distributed as the case may be, by or through such other database or its equipment, software or service make the Records available by means of Metadata Harvesting, without the written permission of the British Library.

3.2 Other than with the prior written consent of the British Library, you are expressly prohibited from using the DATABASE for the purposes of:

3.2.1 reproducing, retransmitting, distributing, redistributing, disseminating, selling, publishing, broadcasting or circulating the RECORDS by any means whatsoever;
3.2.2 allowing access to the DOWNLOADED RECORDS to any third party.

4.  CHANGES TO THE SERVICE

4.1 The British Library may make additions to or deletions from the DATABASE without notice. The British Library will whenever possible give advance notice of any change. The journals available within the DATABASE are subject to the continuity of their publication.  The British Library is not liable for the provision of RECORDS for any title that might cease publication. 

5.  LIABILITY

5.1 The British Library will make all reasonable efforts to ensure that the information provided is free of errors and up to date, but it gives no guarantees as to the accuracy of that information or its fitness for any purpose whatever.

5.2 The British Library shall not be liable in contract, tort or otherwise for any direct, indirect or consequential loss or damage sustained by you or others directly or indirectly making use of the RECORDS or the DATABASE, including but not limited to any loss or damage resulting as a consequence of any defects, delays, interruptions or failures or inaccuracies or errors in the RECORDS or the DATABASE and specifically excludes liability for the same to the fullest extent permitted by law.

6.  INDEMNITY

6.1 You undertake to indemnify and keep indemnified at all times the British Library against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsoever (including legal and other fees and disbursements) sustained, incurred or paid by the British Library directly or indirectly in respect of any breach by you of any of these terms and conditions.

7.  SUSPENSION OF SERVICE

7.1 The British Library, or DIMDI may suspend your access to the DATABASE without prior notice if you have broken any of the terms and conditions of use.

8.  INTELLECTUAL PROPERTY RIGHTS

8.1 All rights in the DATABASE are the property of the British Library Board.  Any rights that subsist in the RECORDS remain the property either of the British Library Board or individual publishers contributing to the DATABASE.  All rights reserved.

8.2 You agree not to remove, deface, or amend any rights statement on a RECORD.

8.3 You shall not use or adopt any trade mark, trade name, logo or commercial designation that includes or is similar to or may be mistaken for the whole or any part of any trade mark, trade name or commercial designation used by the British Library.
